American Angst

The big news is that the Supreme Court of the United States upheld the individual mandate which is the central piece of the legislation. Basically the entire law was upheld except that states can now opt out of medicaid expansion; that was not a part of the original legislation. 

The expected answers from the conservative governed states is that they are happy they can opt out of expanding medicaid and not be penalized for doing so. The expanded medicaid coverage would allow non-elderly individuals with incomes up to 133 percent of the poverty line to receive health benefits. This would cover another 16 million citizens by 2019. 

Silly conservatives. The federal government would pay 100 percent of the expansion for the first three years and then slowly go down to 90 percent of the cost by 2020 and every year after. Sounds like the cost/benefit ratio for individual states would be good thing, unless you are a Republican.

Mitt Romney's campaign is still saying they'll repeal the law, but if they lose this election they might as well give up on the thought. The benefits of the act will by then be effecting millions of Americans, and they will not want to give those benefits away.

No need to point out the states that are claiming they will opt out. If it is conservative led, citizens will be denied that basic human need; health care.

In a bright moment for FOX and CNN, both reported that the ACA had been overturned by the Supreme Court causing ten minutes of insanity from politicians and talking heads. 

Chief Justice John Roberts has been taking a lot of flack for his decision, by those that are supposedly on his side. No good deed goes unpunished in GOPville. It would seem a victory for conservatives in at least one point. Roberts has gutted the Commerce Clause, which in the long run is something conservatives will embrace.

The Supreme Court has been busy. This week they also struck down most of Arizona's immigration laws. Unfortunately they approved the part that allows officers of the law to check the immigration status of anyone they pull over. Still racial profiling to me. 

The court also upheld their Citizen's United case by overturning Montana's long standing "copper kings" law. There was hope that Montana's rejection of Citizen's United might bring the case back up for review; no joy there.

The tea party controlled house voted to hold Attorney General Eric Holder in contempt for giving them everything they asked for. Though possibly not as important as the ACA ruling, it is the oddest political story I've seen in a long time. The history behind the pursuit of Holder by conservatives is one long strange road; think NRA and supposed crazy conspiracies by the left to use the issue for gun control.

Education Enemies

Presidential candidate Mitt Romney stated last Wednesday that students should get as much education as "they can afford." Since he supports the Paul Ryan budget plan to cut Pell grants, and he supports profit driven education, students would be wise to be out in force coming election day. If you're poor, you will always be poor since you will not have access to higher education. 

Another defeat for education was the extension of the student loan interest rate. Though it kept the rates from doubling, it will add 20 billion dollars worth of debt for students. Starting this week all federally subsidized student loans will be charged interest. It used to be that no interest was accrued on loans while in school or for a 6 month grace period after finishing. 

This didn't accomplish the goal.

God's Greatest

American Family Association's pundit Bryan Fischer went all in with his latest rant. If you care about the environment, Satan is behind you. Gay rights and abortion, all the devil's doing. Apparently this is a weekly thing for him now, his last rant was that by allowing gay couple to have families we are all supporting child abuse.

Jan Michelson is upset that nuns are riding around on a bus protesting the Paul Ryan budget. His solution? Drag them off the bus and pistol whip them. Shows the lack of respect christian conservatives have for women, even women believers are fair game.

Nuns, get your guns.

Wicked Women

In Mississippi a new law that requires abortion providers to be certified OB/GYNS and have privileges at the local hospital will apparently shut down the last remaining clinic in the state. 

Starting today in South Dakota, a new law comes into effect that will require doctors to ascertain whether she has been coerced into having an abortion, or if she is at risk of psychological disorders. Happily a federal judged blocked much of the law. No 72 hour waiting period and no visits to anti-abortion clinics.

In New Hampshire, Governor John Lynch vetoed a bill preventing late term abortions. That veto has been overturned by the legislature and will become law. Governor Lynch stated there was already a federal law on the books about late term abortions, but the legislative bodies disagreed. Now if a woman's life is in danger from her pregnancy, two doctors must concur that there is a danger. 

In Florida, a woman is being allowed to sue over denial of contraception. The lady was raped. A doctor gave her two emergency contraception pills, but when she filed the report on the rape, officers found out she was wanted. She was put in jail and her items confiscated, including the other pill that she was supposed to take. The next morning she asked for the pill, the guard refused claiming it was a matter of conscience. 

Planet Politics

I will not being doing planet politics very often. I do not think I have the understanding that a native of a certain country would have on local news and politics.

Rep. Joe Walsh Attacks Double Amputee Veteran Again, Says She Uses ...

Despite earning widespread condemnationfor dismissing the military service of a double amputee woman, Rep. Joe Walsh (R-IL) has decided his original comments didn’t go far enough.

In a statement released this evening on his campaign website, Walsh again refused to apologize, instead attacking Tammy Duckworth — his Democratic opponent who lost both her legs in an insurgent attack in Iraq — for allegedly using “her service and the service of others as a political ploy.”

Presenting himself as the real victim in this ordeal, Walsh claimed he was being accused “of something that is not true.” (Watch his original comments here and judge for yourself.) “Shame on her for using veterans,” he declared, despite having never served in the military himself.

From Walsh’s website regarding the “Duckworth Attack”:

Friends,

My opponents are once again trying to accuse me of something that is not true. It has become their agenda this Fourth of July week to twist my words and claim I said my opponent is not a hero and have insulted all veterans as a consequence. Folks, if you’re familiar with me and my campaign, you know this is utterly false. Shame on her for saying this and shame on her for using veterans in this fashion. In fact, recently on the Big John and Amy Show I stated, “Tammy Duckworth’s service demands our respect and that is something I will do and say for her throughout this campaign.” I open all my town halls byrecognizing our veterans who served to protect our great nation.

Tammy Duckworth knows this and should know better than to use her service and the service of others as a political ploy to distort my words and distract voters. We as a people are facing great problems in our country, and it is time for us to get serious and address them.

Many pundits are referring to Walsh’s comments as a major gaffe, but that’s incorrect. It’s not a gaffe if you mean it.

Bev Perdue’s (D-NC) veto of the rewritten Racial Justice Act. The landmark legislation allowed North Carolina death row inmates to reduce their sentences to life in prison without parole if they could show their sentences were based on widespread racial bias. The rewritten bill severely limits the use of statistics to prove widespread discrimination. In her veto statement, Gov. Perdue said: “[t]his year’s Senate Bill 416 is not a ‘compromise bill’; it guts the Racial Justice Act and renders it meaningless.” The veto-override passed the House 72-48 and the Senate 31-11.

How Democrats fall into the welfare trap

Digby and Dave Dayen have been doing a tremendous job of highlighting the ridiculous conventional wisdom that all of the GOP governors will opt in to the Medicaid expansion in ACA simply because the hospitals want them to. The CW assumes that Republican governors are driven purely by corporate greed, rather than a deep ideological commitment to the idea that the undeserving poor should be left to suffer out of a sense of Calvinist cosmic justice. For GOP governors and their base, there are two kinds of people: those who deserve to prosper and be happy and those who don't. For them, the greatest injustice in the world is the taking of their tax dollars to assist the undeserving, and the removal of their private authority to abuse and exploit the undeser....

Sometimes the definition of "undeserving" is based on race. Sometimes on gender. Sometimes on sexual orientation. Sometimes simply based on how much money one has, which in circular fashion is itself proof of one's worth. Sometimes it's all of the above. But for modern Republicans, it's about much more than just the money. It's about ideology.

Which in turn leads to a very important point that Digby made earlier:

But then that was always going to be a problem when they decided to continue to have a taxpayer funded program for the poor rather than a taxpayer funded program for everyone.

This is the heart of the problem. The reason that Social Security and Medicare are so popular is because they're for everyone over the age of 65. From a financial and economic justice standpoint it would make sense to means test social security so that multimillionaires aren't getting those government checks. But from a political standpoint it would be a disastrous conversion of a popular universal program into a welfare program for the less fortunate. Social Security works functionally and politically because everyone over a certain age is eligible for it. The same goes for Medicare.

By making Medicaid subsidies and targeted secondary populations like young adults and those with pre-existing conditions the liberal core of the Affordable Care act, we have once again taken what should be a universal program (Medicare for All) and made it lesspolitically palatable by converting it into a safety net patch for the less fortunate. That in turn opens progressives up to the old liberal stereotype of someone who wants to take "normal" Americans' money and give it to degenerate ne'er-do-wells, and also makes it easy for ideologically conservative governors to slash the most important part of the program, leaving only a few crumbs and a mandate to buy private health insurance for everyone else.

I've said it before: what made the New Deal so popular and effective was the fact that most of its programs benefited everyone (well, at least everyone white.) The Civil Rights Era alienated a huge number of Americans who weren't yet prepared to see women and minorities as equally deserving human beings. For liberalism to be politically palatable for enough of the public, the benefits of liberalism cannot be seen as going overwhelmingly to people that suburban and rural whites consider to be less than fully deserving of the same empathy and basic rights that they themselves enjoy.

As the Affordable Care Act becomes increasingly associated with Medicaid, and as Republicans continue to demonize it as taking away Medicare money to give to "undeserving" people, the Affordable Care Act itself will be unpopular.

Democrats need not be shocked by Republican governors' refusal to accept Medicaid funds, and they need not feel that the experience of the Affordable Care Act means that Americans don't like "socialized medicine." What Democrats need to learn from this experience is that Democrats need to avoid the welfare trap, and need to embrace the power of universal social insurance.

Universal social insurance has always been popular and will remain popular when implemented. It's just a matter of having the courage to enact it in the first place.

Deadbeat dad and all around douchebag Joe Walsh kicks up the boorishness another notch:

WALSH: Understand something about John McCain. His political advisers, day after day, had to take him and almost throw him against a wall and hit him against the head and say, “Senator, you have to let people know you served! You have to talk about what you did!” He didn’t want to do it, wouldn’t do it. Day after day they had to convince him. Finally, he talked a little bit about it, but it was very uncomfortable for him. That’s what’s so noble about our heroes. Now I’m running against a woman who, my God, that’s all she talks about. Our true heroes, it’s the last thing in the world they talk about. That’s why we’re so indebted and in awe of what they’ve done.

First things first. That Joe Walsh, another wingnut warmongering chickenhawk, would even dare to criticize double amputee Tammy Duckworth’s service, is enough to wish the motherfucker would go hunting with Dick Cheney.

Now let’s unpack the rest of this nonsense. The notion that McCain refused to talk about his service is simply absurd. It’s all he ever talked about, to the point that I had to make a new tag for this website. The theme of his campaign was… “COUNTRY FIRST,” which was a direct reference to his service and time as a POW. Here’s a link to McCain’s introduction video at the Republican convention in 2008. Florida Rape Victim Sues County Jail After Being Denied Emergency C...

A Florida rape victim is suing her county jail and its medical contractor after one employee allegedly refused to give her emergency contraception, citing religious reasons.

After the woman — identified as R.W. — was raped, she went to the jail to identify her assailant. While there, the victim was placed under arrest for an outstanding warrant. It was during this arrest that the incident occurred.

According to the court filing, R.W. had taken one of a two-pill emergency contraception set. But when she needed to take the second pill, the difficulty began:

The next morning, January 28, 2007, Plaintiff requested the second anti-conception pill from Spinelli, explaining that Plaintiff had recently been raped, visited the Rape Crisis Center, and had a prescription from a medical doctor instructing her to take the second pill after twelve hours to prevent the rape from resulting in pregnancy. Spinelli refused to administer the pill to Plaintiff, allegedly stating that it was against her religious beliefs.

This is yet another example of the disturbing trend of conscience-clause excuses for not providing emergency assistance to rape victims. Florida has such a clause, which allows health care providers to deny care if it goes against their religion. Another incident, where a doctor in Oklahoma denied emergency contraceptives to a rape victim, relied on the same “religious beliefs” excuse.

R.W’s rape did not result in pregnancy, and she was permitted to take the second pill — though late — under another person’s supervision.

The Betrayal Begins

Yes, patriots, it’s started again. The shadowy forces that have brought America to its knees, in chains of Big Government, ready for the yoke of Secular-Sharia law, its men emasculated by feminists and the Nanny State, its God-dictated Constitution in tatters, are on the brink of stealing another election, just as it appeared you were taking your country back from the Kenyan Muslim Athiest who has befouled the White House for far too long.

And as in 2008, the America-hating elites are operating through a Manchurian candidate, or rather two of them: Barack Hussein Obama, to be sure, but also his opponent.

The plot was revealed when the Trojan Horse of the U.S. Supreme Court, John Roberts, stabbed the brave conservatives of the Court in the back, but was forced to reveal the obvious truth that the unconstitutional ObamaCare law was a monstrous tax on God-fearing American job-creators for the benefit of the looters who feed at the public trough yet pay no taxes themselves. Just as battle-cries erupted from the throats of a million warriors for freedom, however, their purported champion, Mitt Romney, showed his cowardly hand and bent his knee to the enemy. National Journal’s Josh Kraushaar lays out the horrifying truth:

In the aftermath of the Supreme Court health care ruling, the early conventional wisdom was that an unfavorable health care ruling at the court would be good for Republicans politically, even as it was a serious policy setback for conservatives. But that’s not shaping up to be the case. Mitt Romney, after giving a brief statement decrying the decision, has been virtually silent on criticizing the health care law. He’s been on vacation and his campaign has been giving off clear signals that it doesn’t want to make health care a major part of the election….
For an issue that’s supposedly potent against Democrats, Romney’s campaign is declaring a cease fire. This, even as the law polls unfavorably and it proved to be a motivating force for Republicans and disaffected independents in the 2010 midterms.
It’s becoming clear that Romney has decided to focus on the economy at the expense of everything else, even issues that could play to his political benefit. He’s avoided criticizing the administration’s handling of the botched Fast and Furious operation, even as it threatens to become a serious vulnerability for the president. He’s been silent in responding to Obama’s immigration executive order, not wanting to offend receptive Hispanics or appear like a flip-flopper. He appears more likely to tap a safe, bland running mate like Ohio Sen. Rob Portman or former Minnesota Gov. Tim Pawlenty who won’t do him any harm but won’t benefit him much either.

Sound familiar, patriots? Yes, the RINOs are in charge once again, determined to snatch defeat from the jaws of victory.

Joel Pollak of Breitbart.com speaks for the real America in throwing down a challenge to the sell-out Romney:

The Tea Party has been ready to rally to Romney’s side over the Obamacare decision, overlooking his past in order to use him as the vehicle for repealing Obamacare and toppling Obama. But if Romney won’t fight for conservative principles, the Tea Party is going to start looking elsewhere—fast. No one wants to live through the frustration of October 2008 all over again. No one wants to watch another conservative capitulate to Obama.
This ain’t Etch-A-Sketch, Mitt. Go hard or go home.

No, patriots, you cannot wait until the late stages of the campaign to protest the refusal of another Republican nominee to fight for you, as you did in 2008 when John McCain muzzled Sarah Palin and refused to expose the alien Marxist background of The One. On this eve of the anniversary of the Declaration of Independence, the document that established this Republic as a divine mission for the protection of property rights and of the unborn from the moment of conception, begin to prepare to march on Tampa and take back the Republican Party! Ignore the mockery of the media conspirators who tell you this cannot be done! Overwhelm the ranks of the New Black Panther Party militants and ACORN community activists who will bar your path! Victory is yours for the taking!
