Snyder’s Got Pontiac Schools in His Sights

crystal ballAnd now it’s Pontiac Public Schools. Gov. Snyder was told yesterday by the three-member Local Emergency Financial Assistance Loan Board that the district is in probable distress. The governor will now assign a review team to the district to determine if they are in a financial emergency under the provisions of the new Emergency Manager law, Public Act 436 of 2012. Democracy Tree doesn’t need a crystal ball to assure our readers that the team will declare that the sky is indeed falling in Pontiac Schools. They will soon join the City of Hamtamck who, just a few days ago, were told to choose between emergency management, a consent agreement, a neutral evaluation process, or chapter 9 bankruptcy.

BREAKING: Snyder and Dillon Sued Over Emergency Manager Law

The United Retired Government Employees and The City of Pontiac Retired Employees Association have filed a federal lawsuit against Governor Rick Snyder, Treasurer Andy Dillon, Emergency Managers Lou Schimmel of Pontiac, and Ed Kurtz of Flint, and the Michigan Municipal Employees Retirement System.

The complaint seeks to block the transfer of retirement funds to the state, and to overturn the new Emergency Manager Law. The suit invokes the supremacy clause claiming that the Emergency Manager law is in violation of federal bankruptcy and contract clauses of the U. S. Constitution.

The suit was filed yesterday in U.S. District Court and assigned to Judge Julian Bell Cook.

A joint press release from the plaintiffs made a compelling argument against Gov. Snyder’s Emergency Manager law. Printed below, in its entirety:

UNITED RETIRED GOVERNMENT EMPLOYEES AND THE CITY OF PONTIAC RETIRED EMPLOYEES ASSOCIATION JOINT PRESS RELEASE:

A spectre is haunting Michigan: The spectre of corruption.

As Governor Snyder wines and dines Wall Street at the pricey hotels and exclusive receptions on Mackinac Island, Michigan’s cities rot, retirees live in fear of losing health care coverage and students wonder if they will have a school to go to in the fall.

Emergency Managers have stripped cities and their residents, retirees, students and workers of their assets, health care, pension systems, vital services and their basic right to open government and democracy. Emergency Managers do not serve the public, but institutional banks that helped create the current fiscal problems with reckless and speculative investments. Now that Michigan has been devastated, in large part by Governor Snyder’s disastrous cuts in revenue sharing, the Emergency Managers have come to strip communities to the bone, one by one. Under Governor Snyder’s watch, only Wall Street is safe. And they are safe because Governor Snyder and his political appointees have turned Michigan’s cities and school districts into corporate feudal estates.

This danger is not new. Our Founding Fathers were aware of the danger posed by powerful economic factions, including speculative investors. They designed the Bankruptcy Clause and Contracts Clause to prevent those factions from rigging state government at the expense of third parties with conflicting or competing claims.

Michigan’s main street has had enough. Today, Michigan’s public sector retirees join together and demand that the unconstitutional rule by decree stop at once.

Ed Schultz on Michigan Gov't Takeover: An "All-Out Assault" on the Voting Rights of Black Voters


After being granted the power to do so by the legislative, Michigan governor Rick Snyder has already appointed "emergency managers" to four Michigan cities, thereby invalidating the power of local voters, elected officials, and governing boards--and now he has his eye on Detroit. Sounds fishy? It should--particularly when you notice that the cities being targeted by this move are almost all majority Africa-American, which means black citizens in particular are being disenfranchised.

I received this message from a local MoveOn member.

Four bills introduced to the Michigan House on Nov. 3, 2011 (House Bills 5149-5151 and 4736) must be passed to protect the largest source of above-ground freshwater in the world, the Great Lakes and their feeder water system inside the State of Michigan, from use by hydraulic fracturing companies seeking to drill for natural gas in Michigan shale. A moratorium must delay drilling until impact studies are completed by the EPA and Michigan's Department of Natural Resources and Department of Environmental Quality.

So I signed a petition to The Michigan State House, The Michigan State Senate, Governor Rick Snyder, The United States House of Representatives, The United States Senate and President Barack Obama, which says:

"Natural gas hydraulic fracture drilling must be delayed to await impact studies by the EPA and environmental agencies inside states where drilling is to be carried out."
